Terms of Service

These Terms of Service ("Terms") govern your access to and use of Artlapse ("the Service"), operated by Erik Rodny (trading as Artlapse), Golfvägen 16, 181 29 Lidingö, Sweden. By using Artlapse you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use Artlapse. By creating an account, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

2. Your Account

You sign in using your Google account. You are responsible for all activity that occurs under your account. You must not share your account with others or allow others to use it. Notify us immediately at [email protected] if you suspect unauthorised access to your account.

During the beta period, access to Artlapse requires an invite code. We reserve the right to revoke access at any time, for any reason or no reason, during the beta period.

3. Content You Post

Ownership

You retain full ownership of the content you upload to Artlapse. We do not claim ownership of your videos, images, or other content.

Licence to Artlapse

By uploading content, you grant Artlapse a non-exclusive, worldwide, royalty-free licence to store, display, transcode, distribute, and promote your content on the platform and in connection with the Service. This licence ends when you delete the content or your account, except where we are required to retain it by law.

No guarantee of availability

We do not guarantee that content will be stored or made available indefinitely. Content may be removed for violations of these Terms, at our discretion, or in the event the Service is discontinued.

Your responsibility

You are solely responsible for the content you post. You confirm that you own or have the necessary rights and permissions to post your content, and that it does not infringe any third party's rights.

4. Prohibited Content and Conduct

You may not use Artlapse to post, share, or promote content that:

• Infringes any copyright, trademark, or other intellectual property right
• Is sexually explicit, pornographic, or involves minors in any sexual context
• Promotes or incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic
• Harasses, threatens, or intimidates any individual
• Is defamatory, misleading, or fraudulent
• Contains malware, spam, or unauthorised advertising
• Violates any applicable law or regulation

You may not attempt to gain unauthorised access to the Service, disrupt its operation, or use automated means to scrape or interact with the platform without our written permission.

We may limit, restrict, or disable features or accounts that generate excessive load or negatively impact the stability or performance of the Service, including but not limited to mass uploading, bandwidth abuse, or automated activity.

5. Copyright and DMCA

Artlapse respects intellectual property rights. If you believe that content on Artlapse infringes your copyright, please send a written notice to our DMCA-registered designated agent:

Your notice must include: (1) identification of the copyrighted work; (2) identification of the infringing content and its location on the platform; (3) your contact information; (4) a statement that you have a good faith belief the use is not authorised; (5) a statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner; and (6) your signature.

We will process valid notices promptly and remove infringing content in accordance with the DMCA safe harbour provisions.

6. Reporting Illegal Content (DSA)

In accordance with the EU Digital Services Act (DSA), users can report allegedly illegal content or content that violates these Terms using the report button available on every post and profile, or by contacting us at [email protected].

We process all notices in a timely, diligent, and non-arbitrary manner. When submitting a report, please include the URL of the content and a description of why you believe it is illegal or in violation of our guidelines. We will inform you of the outcome of your report where required by law.

7. Advertising

Artlapse may display advertisements in the future. When advertising is active, it will be provided by third-party networks such as Google AdSense. We do not endorse the products or services advertised. Advertising cookies will only be placed with your explicit prior consent.

8. Modifications to the Service

We may modify, suspend, or discontinue the Service (or any part of it) at any time without prior notice and without liability. We do not guarantee uninterrupted or error-free access to the Service.

9. Enforcement and Termination

We reserve the right to remove any content, suspend, or permanently ban any account that violates these Terms, at our sole discretion and without prior notice. During the beta period, we may also restrict or terminate access for any reason or no reason.

You may delete your account at any time through the settings page. Upon deletion, your content will be removed from the platform within 30 days.

10. Indemnification

You agree to indemnify, defend, and hold harmless Artlapse and Erik Rodny from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your content, your use of the Service, or your violation of these Terms.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the content posted by users.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Artlapse and Erik Rodny shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability shall not exceed the greater of €100 or the amount you paid to us in the past 12 months.

13. Governing Law

These Terms are governed by and construed in accordance with Swedish law. Any disputes shall be subject to the exclusive jurisdiction of the Swedish courts, with Stockholm District Court (Stockholms tingsrätt) as the court of first instance.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. We will notify you of significant changes through the platform.
